Terms of Service

1. SERVICE PROVIDER INFORMATION

2. ACCEPTANCE OF TERMS AND CONDITIONS
By booking and collecting the bicycle, the user fully accepts these Terms and Conditions. Failure to comply with any clause will result in the immediate termination of the contract and may lead to penalties. In the case of a group booking, I, the undersigned, accept full responsibility for myself and for the entire group included in the reservation.

3. RENTAL REQUIREMENTS

  • Rental is permitted only to individuals aged 18 or older. Minors must be accompanied by an adult.
  • A valid ID must be presented to rent a bicycle.
  • The customer is responsible for the bicycle from the moment it is delivered until it is returned to the designated location.

4. USER’S RESPONSIBILITY
I, the undersigned, accept full responsibility for the safekeeping and proper use of the rented bicycle.

  • In case of theft or loss, I will be liable for reimbursing the full value of the bicycle:
    • €2,500 for bicycles: Cannondale, Moustache, Tornante, and Bianchi.
    • €4,300 for 3T bicycles.
  • In case of damage, I will be liable for the cost of spare parts at the current retail price, and for the labor cost of €35/hour (excluding VAT).
  • In the event of a malfunction, I agree to immediately stop using the bicycle and contact Torto Cicli s.a.s.

5. SAFETY AND USAGE RULES

  • I agree to always wear a protective helmet.
  • I am aware that cycling involves a risk of injury and I consciously and voluntarily accept these risks.
  • I agree to comply with the Highway Code while using the bicycle.

6. RENTAL AND PAYMENT CONDITIONS

  • The rental fee must be paid in advance.
  • Payments are accepted via credit card or PayPal.
  • In case of late return, a penalty of €10.00 will be applied for each rented bicycle.

7. CANCELLATION AND REFUND POLICY

  • Cancellations are allowed up to 48 hours before the scheduled pickup time. A 3% commission will be deducted from the amount paid.
  • No refunds will be issued for late cancellations.

8. LIMITATION OF LIABILITY
By signing this document, I release Bici in Langa di Torto Cicli s.a.s., its representatives, and employees from any liability for personal injury, death, or property damage resulting from the use of the bicycle.

9. PRIVACY AND PERSONAL DATA PROCESSING
Pursuant to Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/03, I declare that I have been informed about the purposes and methods of processing the personal data provided.

10. APPLICABLE LAW AND JURISDICTION
This contract is governed by Italian law. For any disputes, the Court of Asti (AT), Italy, shall have exclusive jurisdiction.

I, the undersigned, declare that I have read this contract carefully, understand its content, and accept all its terms and conditions.
